In a Civil Application before a single Justice of the Supreme Court, Justice Augustine Nshimye, held that in an application for enlargement of time to file an Appeal, the discretion to open or not open the gates of Court is vested in the Court.
Such an application for extension of time may be granted namely:
a) Before expiration of limited time
b) After the expiration of the limited time
c) Before the act is done
d) After the act is done
The learned Justice finally ordered that the time within which the applicant had to appeal be enlarged, after being satisfied that the Applicant had established the sufficient reasons for having failed to appeal in time.
